Terms & Conditions of Delivery

By using the services of POS WITH US, the Sender agrees to all terms and conditions listed below. These terms define the rights, responsibilities, and limitations of both the Sender and POS WITH US in connection with the transportation and delivery of goods.

1. Packaging Responsibility

The Sender is fully responsible for ensuring that all shipments are properly packed to protect the contents during transportation.

Any loss or damage caused by improper or insufficient packaging shall be the sole responsibility of the Sender.

POS WITH US reserves the right to repack items if deemed necessary for safety or compliance purposes.

2. Weight and Billing Reference

Charges are calculated based on the greater of the actual weight or volumetric (dimensional) weight of the shipment.

If additional packing is performed by POS WITH US to ensure safety or compliance, the final packed weight and dimensions will be used as the billing reference.

3. Declaration of Goods

The Sender must provide accurate and complete information regarding the contents and declared value of the shipment.

Any false, incomplete, or misleading declaration is the full responsibility of the Sender, including potential legal consequences or shipment delays.

4. Prohibited and Restricted Items

POS WITH US strictly prohibits the shipment of the following items:

  • Human remains or body parts
  • Live or dead animals
  • Illegal drugs or narcotics
  • Firearms, ammunition, and explosives
  • Flammable, radioactive, or toxic substances
  • High-value fine art or antiques
  • Securities, cash, precious metals, jewelry, or items of similar nature
  • Any goods prohibited by Indonesian law or international transport regulations

Shipments containing such items may be refused, seized, or destroyed without compensation.

5. Inspection Rights

POS WITH US reserves the right — but not the obligation — to open and inspect any shipment to verify compliance with applicable laws and company policies.

If prohibited or undeclared items are found, the Sender agrees to release POS WITH US from any liability, costs, or claims from third parties arising from such shipments.

6. Force Majeure & Operational Limitations

POS WITH US does not guarantee uninterrupted delivery services in cases of force majeure or events beyond its control.

This includes, but is not limited to, natural disasters, political unrest, strikes, transport accidents, customs delays, or other external disruptions.

7. Insurance

The Sender is responsible for obtaining adequate insurance coverage for their shipment and bears the corresponding premium cost.

If the shipment is insured through POS WITH US, compensation for loss or damage will follow the terms and limits of the insurance policy in effect.

If no insurance is purchased, compensation will be limited to the maximum liability stated in POS WITH US’s internal regulations.

8. Limitation of Liability

POS WITH US shall not be liable for any indirect, incidental, or consequential loss, including delay, loss of profit, or emotional distress, arising from shipment handling.

No compensation will be provided for loss or damage resulting from events outside the reasonable control of POS WITH US, including acts of nature (Force Majeure).

9. Delivery Acceptance

If the recipient does not raise any complaint at the time of delivery, the shipment is considered received in good condition and accepted without dispute.

Any subsequent claims after acceptance may not be honored.

10. Claims & Complaints

Claims for loss or damage must be submitted by the Sender (not the Recipient) within three (3) calendar days after delivery, along with supporting documents (receipt, photos, declaration, etc.).

Claims submitted beyond this period may not be accepted for processing.

11. Legal Agreement

No agreement, promise, or representation other than these Terms & Conditions shall bind POS WITH US unless approved in writing by an authorized company representative.

All verbal or implied agreements outside this document are not legally enforceable.

12. Acceptance of Terms

By handing over the shipment to POS WITH US, the Sender acknowledges that they have read, understood, and agreed to all Terms & Conditions stated herein, without coercion from any party.

The Sender further agrees to release POS WITH US from any legal claim or demand arising from the shipment, except as provided under these terms.
